Terms of Service

1. Acceptance of Terms

By accessing or using the Cosmic Echo website (cosmicecho.ai) and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service. We reserve the right to modify these Terms at any time. Your continued use of the Service constitutes your acceptance of any changes.

2. Description of Service

Cosmic Echo provides a service whereby personal messages submitted by users are encoded and transmitted as radio signals into space. The Service includes: message composition, radio transmission, digital and physical Transmission Certificates, and a Signal Tracker web page. The specific features and availability of the Service may change at any time without notice.

3. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you are at least 16 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

4. Orders and Payment

By placing an order through the Service, you agree to pay the stated price for the selected tier (Digital, Printed, or Framed). All prices are in US Dollars (USD) unless otherwise stated. Prices are subject to change at any time without notice, but changes will not affect orders already placed and paid for.

Payment is processed by Stripe, Inc. By making a payment, you also agree to Stripe's terms and conditions. You are responsible for any taxes, duties, or fees imposed by your jurisdiction.

5. All Sales Are Final — No Refunds

All purchases are final and non-refundable. By completing a purchase, you acknowledge and agree that:

  • All sales are final. No refunds, returns, exchanges, or credits will be issued under any circumstances.
  • You are purchasing a service (radio transmission and associated digital/physical deliverables), not a physical product that can be returned.
  • Digital deliverables (Transmission Certificate PDF, Signal Tracker access) are provided immediately or shortly after purchase. Once digital content has been delivered, the transaction is complete.
  • For physical deliverables (Printed and Framed certificates), no refunds are available once production has been initiated, which occurs immediately upon order placement.
  • You waive any right to initiate chargebacks, payment disputes, or reversals for completed purchases. Fraudulent chargebacks may result in account termination and pursuit of all available legal remedies.

This no-refund policy applies regardless of whether the radio transmission has occurred at the time of your refund request. Your purchase secures your message's place in the transmission batch, and this reservation is non-transferable and non-refundable.

6. Transmission — No Guarantees

Cosmic Echo will use commercially reasonable efforts to transmit your message as part of the scheduled transmission batch. However:

  • We do not guarantee any specific transmission date. Scheduled dates (e.g., "July 1, 2026") are estimates and may be changed, postponed, or rescheduled at our sole discretion.
  • We do not guarantee that your message will be received by any entity, organism, or intelligence at the destination or anywhere along the signal path.
  • We do not guarantee any specific signal strength, power, range, duration, or detectability of the transmission.
  • We do not guarantee that the Signal Tracker will be available indefinitely. The Signal Tracker is provided as a complimentary feature and may be modified, suspended, or discontinued at any time.
  • We do not guarantee the accuracy of any distance calculations, astronomical data, or scientific information presented on the website or in certificates.

Transmission is subject to equipment availability, weather conditions, regulatory approvals, technical constraints, and other factors beyond our control. Changes to transmission schedules, destinations, frequencies, or other parameters do not entitle you to a refund.

7. Message Content

You are solely responsible for the content of your message. By submitting a message, you represent and warrant that:

  • Your message does not violate any applicable law, regulation, or third-party rights
  • Your message does not contain threats, harassment, hate speech, or content that promotes violence
  • Your message does not infringe any intellectual property rights
  • You have the right and authority to submit the message for transmission and public display (if you selected public visibility)

We reserve the right to refuse to transmit, remove, or modify any message at our sole discretion, without notice and without refund. We have no obligation to review messages before transmission but may do so at our discretion.

8. License to Your Content

By submitting a message through the Service, you grant Cosmic Echo a perpetual, irrevocable, worldwide, royalty-free, non-exclusive, sublicensable, and transferable license to use, reproduce, display, distribute, transmit (via radio or any other medium), modify, create derivative works from, and otherwise exploit your message content for any purpose, including but not limited to: radio transmission, marketing, advertising, promotional materials, social media, press coverage, merchandise, and any future product or service.

This license survives termination of your account and these Terms. You waive any moral rights in your submitted message content to the fullest extent permitted by law.

9. Irreversibility of Transmission

You acknowledge and agree that once a message has been transmitted as a radio signal, it cannot be recalled, deleted, modified, or stopped. The nature of electromagnetic radiation is that a transmitted radio signal propagates through space indefinitely and is beyond anyone's control once broadcast. This is an inherent characteristic of the Service, not a deficiency, and you accept this limitation.

10. Certificates

Transmission Certificates are commemorative documents. While they contain accurate information about the transmission event to the best of our knowledge, they are not legal documents, scientific instruments, or official records of any governmental or scientific body. The cryptographic hash included on certificates is generated by Cosmic Echo's systems and serves as an internal verification mechanism only.

Physical certificates (Printed and Framed tiers) are shipped to the address provided at checkout. We are not responsible for incorrect addresses, lost packages, customs fees, import duties, or delivery delays caused by postal services or customs authorities. Replacement certificates for lost or damaged shipments may be provided at our discretion and may incur additional charges.

11. Intellectual Property

All content on the Service — including but not limited to text, graphics, logos, images, software, design, and layout — is the property of Cosmic Echo or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Service without our express written permission.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY INFORMATION PROVIDED THROUGH THE SERVICE, INCLUDING BUT NOT LIMITED TO ASTRONOMICAL DATA, DISTANCE CALCULATIONS, AND SCIENTIFIC CLAIMS.

THE SIGNAL TRACKER, DISTANCE CALCULATIONS, AND RELATED FEATURES ARE PROVIDED FOR ENTERTAINMENT AND INFORMATIONAL PURPOSES ONLY AND SHOULD NOT BE RELIED UPON AS SCIENTIFICALLY PRECISE MEASUREMENTS.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, COSMIC ECHO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR $100 USD, WHICHEVER IS LESS.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability shall be limited to the fullest extent permitted by law.

14. Indemnification

You agree to indemnify, defend, and hold harmless Cosmic Echo and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Service; (b) your message content; (c) your violation of these Terms; or (d) your violation of any applicable law or third-party rights.

15. Account Termination

We reserve the right to suspend or terminate your access to the Service at any time, for any reason, without notice and without liability. Termination does not affect any rights or obligations accrued before termination. The provisions of these Terms that by their nature should survive termination shall survive, including but not limited to: ownership, warranty disclaimers, limitation of liability, indemnification, and dispute resolution.

16. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of Finland, without regard to conflict of law principles. Any disputes arising from or related to these Terms or the Service shall be resolved exclusively in the courts of Finland.

You agree to attempt to resolve any disputes informally by contacting us before pursuing formal legal action. Any claim or cause of action arising from or related to the Service must be filed within one (1) year after the event giving rise to the claim, or the claim is permanently barred.

17. Force Majeure

Cosmic Echo shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to: natural disasters, war, terrorism, government actions, equipment failures, power outages, internet disruptions, satellite failures, regulatory changes, pandemics, labor disputes, or any other event beyond our control. Such events do not entitle you to a refund or any other remedy.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be enforced to the maximum extent possible, and the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Cosmic Echo regarding the Service and supersede all prior agreements, understandings, and representations.
